Cleared of Charges, But It's Still on Your FBI Record? Here's How to Fix It

Even if an investigation never led to criminal charges, it can still appear on your background check. Being "titled" as the subject of a CID, OIS, or NCIS investigation can derail future employment, especially with a local, state, or federal government agency.

What to Expect

The Record Correction Process

If you were "titled" as the subject of a military law enforcement investigation, even without criminal charges, that determination can appear on FBI background checks. Correcting or removing this requires petitioning to have the underlying probable cause determination reviewed and, where warranted, reversed. The rules have changed significantly in the past few years, so it is important to have an attorney who is up to date on the law.
